De SvH is volgens #UNCLOS art. 38 een internationale zeestraat waar 'transit passage' geldt (=vrije doorvaart). Iran en de VS zijn echter geen partij bij UNCLOS, maar wel bij de Conventie inzake de Territoriale Zee uit 1958, art. 16.4 die ook 'onschuldige doorvaart' garandeert.
